Federal legislation

  • Disability Discrimination Act (DDA) 1992. Provides protection for everyone in Australia against disadvantage based upon disability. Disability discrimination happens when people with a disability are treated less fairly than people without a disability. Access to shelters falls under the definition of ‘premises’ (DDA Section 4).
  • Airports Act 1996 and regulations. Establish a framework for the protection of airspace at and around airports (to prevent bird / bat strike).
  • Environment Protection and Biodiversity Conservation Act 1999 and Environmental Protection and Other Legislation Amendment Bill (EPOLA) 2014. Provides a legal framework to protect and manage nationally and internationally important flora, fauna, ecological communities and heritage places. Lists species that are threatened nationally.
  • Exemptions apply to some native vegetation clearing activities under:
    • Forestry Act 1959. An Act to provide for forest reservations, the management, silviculture treatment and protection of State forests and for other purposes
    • Fire and Rescue Service Act 1990. An Act to establish the Queensland Fire and Emergency Service, to establish a fund for particular purposes, to provide for the prevention and the response to fires and emergency
    • Disaster Management Act 2003. To help communities mitigate the potential adverse effects of an event, effectively respond to, and recover from, a disaster or an emergency situation.
  • National Environmental Protection Council Act 1994 sets national objectives for protecting or managing particular aspects of the environment.
  • Water Act 2007 and regulations. An act to provide for the sustainable management of water and other resources and the establishment and operation of water authorities, and for other purposes.

Components of this document may be used within a contract document but users should undertake their own investigations to confirm the information is suitable for this purpose.
