Queensland legislation

  • Aboriginal Cultural Heritage Act 2003. An Act to make provisions for Aboriginal cultural heritage.
  • Anti-Discrimination Act 1991 (ADAQ Section 46). To promote equality of opportunity for everyone and to protect them from unfair discrimination. Access to embellishments falls under the provision of services.
  • Biodiscovery Act 2004. Permits allow investigation in National Parks.
  • Biosecurity Act 2014. Provides guidance for a comprehensive biosecurity framework to manage the impacts of animal and plant diseases and pests in a timely and effective way and ensure the safety and quality of animal feed, fertilisers and other agricultural inputs.
  • Building Act 1975 and regulations – e.g. Building Regulation 2006. Governs all building work in Queensland and empowers the regulation of certain aspects of buildings and structures.
  • Building Regulation 2006. Regulations pertaining to building activities in Queensland.
  • Clean Energy Act 2008. Medium sized energy users are required to identify measures to reduce energy consumption and promote energy efficiency.
  • Coastal Protection and Management Act 1995. Provides guidance for the protection, conservation, rehabilitation and management of the coastal zone, including its resources and biological diversity.
  • Coastal Protection State Planning Regulatory Provision 2013. A state planning regulatory provision that sets out the requirements for ensuring coastal protection in Queensland.
  • Dangerous Goods Safety Management Act (Qld) 2001. Regulates the storage and handling of hazardous materials, dangerous goods and combustible liquids.
  • Electrical Safety Act 2002 and regulations. An Act about electrical safety, and for other purposes.
  • Electricity Act 1994. Regulates the construction of power lines with respect to vegetation clearing and habitat fragmentation.
  • Electricity – National Scheme (Queensland) Act 1997. To make provision for the operation of a national electricity market and for other purposes.
  • Environmental Protection Act 1994 and regulations. The object of this Act is to protect Queensland’s environment while allowing for development that improves the total quality of life, both now and in the future, in a way that maintains the ecological processes on which life depends (ecologically sustainable development).
  • Fisheries Act 1994. An Act for the management, use, development and protection of fisheries resources and fish habitats, the management of aquaculture activities and helping to prevent shark attacks, and for related purposes.
  • Forestry Act 1959. Regulates removal of timber, other forest products and quarry material from state land.
  • Land Act 1994 and regulations. Management and administration of non-freehold land and deeds of grant in trust.
  • Land Title Act 1994 and regulations. Registration of freehold land and interests in freehold land.
  • Liquor Act 1992 and regulations. In Queensland it is an offence to drink alcohol or possess an opened alcoholic drink in a public place.
  • Local Government Act 2009 (LGA) and regulations. Provides for the extent and nature of local government responsibilities and powers.
  • Nature Conservation Act 1992 and regulations. Establishes a framework for creation and management of protected areas and protection and management of native flora and fauna.
  • Planning Act 2016 and regulations. To establish an efficient, effective, transparent, integrated, coordinated, and accountable system of land use planning, development assessment and related matters that facilitates the achievement of ecological sustainability.
  • Plant Protection Act 1989 and regulations. The main object of this Act are to:
    • prevent, control or remove pest infestation of plants in Queensland.
    • help other jurisdictions prevent, control or remove plant pests, diseases, pest infestations, infections or conditions.
    • facilitate the movement of plants into and out of Queensland.
  • Plumbing and Drainage Act 2002 and regulations e.g. Standard Plumbing and Drainage Regulation 2003. An act about plumbing and drainage, the licensing of plumbers and drainers, and for other purposes.
  • Public Health Act 2005, regulations and guidelines. An act to protect and promote the health of the Queensland public.
  • Professional Engineers Act 2002. To protect the public by ensuring professional engineering services are provided by a registered professional engineer in a professional and competent way.
  • Queensland Building and Construction Act 1991 (QBCC Act). Regulates the building industry ensuring proper standards and remedies for defective building works.
  • State Development and Public Works Organisation Act 1971. Environmental impact statement process for significant projects.
  • Transport Operations (Road Use Management) Act 1995 and regulations.
    • Transport and Main Roads – Queensland Road Rules for Cyclists 2013. Bicycles are considered vehicles and must obey all of the general road rules.
  • Transport Infrastructure Act 1994. State roads, railways and ports has a major direct affect on the environment due to physical destruction.
  • Transport Infrastructure Act 1994. Transport Infrastructure (Public Marine Facilities) Regulation 2011. Regulations governing the use of public marine facilities.
  • Tobacco and Other Smoking Products Act 1998 and regulation. To improve the health of members of the public by reducing their exposure to tobacco and other smoking products. Smoking is illegal within 10 m of children’s outdoor playground equipment situated at a place that is ordinarily open to the public.
  • Vegetation Management Act 1999 (VMA) and regulation. Regulates the clearing of native vegetation in Queensland to conserve remnant vegetation, prevent biodiversity loss and maintain ecological processes.
  • Water Act 2000. Provides for the sustainable management of water and management of impacts on underground water, and for other purposes
  • Water Efficiency Labelling and Standards Act 2005. An act to provide water efficiency labelling and the making of water efficiency standards, and for related purposes.
  • Water Supply (Safety and Reliability) Act 2008. An act to provide for the safety and reliability of water supply.
  • Work Health and Safety Act 2011 and regulations e.g. Work Health and Safety Regulation 2011. To provide comprehensively for work health and safety. Designers have a duty of care to comply with, and to ensure, as far as is reasonably practical, that the design is without risks to health and safety.
